Beatriz Fuentes, who believed her husband was having an affair, allegedly threatened to kill him. She assaulted him, it’s alleged, and discharged a handgun outside their Cape Coral home.
Beatriz Fuentes, 55, was arraigned last Friday before Lee County Circuit Court Judge Robert Branning on one count each of fourth-degree domestic assault and unlawful use of a weapon, both Class C felonies, in addition to misdemeanor charges of two counts each of menacing and recklessly endangering another person, and one count of harassment.
Branning set bail at $150,000, and ordered Fuentes to have no contact with her husband if she secures her release from jail by posting the required 10 percent.
Sergeant Corey Kent of the Cape Coral police gave this account of the incident in a probable cause affidavit:
About 10 p.m. last Thursday, officers were dispatched to the Fuentes residence on Southeast First Street on a report of domestic violence. Officers learned Fuentes' husband had removed a gun from the residence and secured it in her car.
He said his wife was sleeping and very intoxicated. Neighbors had arrived at the residence after hearing a very loud commotion at the Fuentes residence.
They told officers that Beatriz Fuentes had repeatedly told them over the phone she was going to kill her husband and then take her own life. The Fuentes' neighbors said she was passed out. However, when Fuentes' husband told the neighbors about a gun being in the residence, and that his wife had assaulted him, they called the police.
About 5 1/2 hours earlier, the Cape Coral Communications Agency dispatch center received a call related to shots possibly being fired at the Southeast First Street address. An officer spoke with Fuentes' husband, but no further action was taken.
When he was contacted as part of the domestic violence investigation, he said he lied to officers who responded to the shots fired call. He said his wife had discharged at least four rounds from a handgun.
Officers noticed his left eye was bruised and swollen. He said his wife got angry when she discovered text messages on his phone between him and another female.
He said she took a handgun, walked out onto the porch and fired four rounds into the ground.
Over the next two hours, after officers who responded to the shots fired call left the residence, Fuentes hit or kneed him from time to time, according to her husband. She would occasionally go outside or into the garage, and when she returned to the house, she would assault him. He said he was struck in the head, stomach and thigh.
He said Beatriz Fuentes threatened to kill him.
Beatriz Fuentes admitted discharging the gun because she was angry about the text messages she found on her husband's phone, and she believed he was cheating on him.
When Fuentes was told that she had informed their neighbors that she was going to kill her husband, she said she didn’t recall saying such a thing. Had that been the case, Fuentes said there would have been evidence of such a crime.
Beatriz Fuentes was told her husband had been assaulted. She said he was swinging on her and pushing her, and she had pushed him away, but she didn’t hit him. The confrontation was only verbal.
Beatriz Fuentes' next court appearance is 1:30 p.m. Monday, Sept. 25, for an arraignment on a grand jury indictment.
